Terms of Service

These Terms of Service ("Terms") govern your use of the ForensicConsent browser extension and related services (the "Service"). By installing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf.
1. License grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for auditing websites you own or are authorized to test, in accordance with these Terms. The Service is licensed, not sold. We retain all rights not expressly granted.
2. Acceptable use
You agree not to:
- use the Service to audit or test sites you do not own or are not authorized to test;
- use the Service to break, overload, or circumvent the security of any system;
- resell, sublicense, or redistribute the Service except as expressly permitted by your plan;
- reverse engineer the Service except to the extent that restriction is prohibited by law; or
- misrepresent a forensic record, alter it, or present it as something it is not.
Forensic records are intended to reflect what the Service observed on the page and date in question. You are responsible for how you use and present them.
3. Free and paid plans
The Service offers a free plan and paid plans. Paid plans differ only by seats and billing terms, as described on our pricing page. We may change plan features or pricing prospectively; changes do not affect a billing period you have already paid for.
4. Billing, renewals and refunds
Recurring paid plans bill in advance on a monthly cycle and renew automatically until cancelled. You can cancel from the billing portal, which you open from inside the extension; cancellation stops future renewals and takes effect at the end of the current billing period. The one-month pass is a one-time charge that does not auto-renew and expires after 30 days.
Except where required by law, payments are non-refundable. If you believe you were charged in error, contact cliff@locustware.com and we will review it in good faith.
5. No legal advice
ForensicConsent is a software auditing tool, not a law firm, and does not provide legal advice. A forensic record is evidence about a page's state at a point in time; it is not a guarantee of legal compliance or a defense to any claim. Consult qualified counsel about your obligations.
6. No warranty
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will detect every tracker or that it will be uninterrupted or error-free.
7. Limitation of liability
To the maximum extent permitted by law, ForensicConsent and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or lost data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
8. Termination
You may stop using the Service at any time by uninstalling the extension. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including Sections 5–7 and 9) will survive.
9. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Midland County, Texas, unless applicable law requires otherwise.
10. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.
